Terms of Service

These Terms of Service apply to CareMessaging.com, the authenticated Care Messaging application and the Care Messaging SMS program operated by Care Analytics LLC (“Care Analytics,” “we,” “us,” or “our”). Paid subscriptions and organization deployments may also be governed by terms presented during account creation or checkout, a service agreement, a business associate agreement or other applicable product terms.

Website information and subscriptions

The website describes Care Messaging products, features, pricing and availability and links to account creation and secure Stripe Checkout. Offerings, usage allowances, pricing and technical capabilities may change, subject to any terms that apply to an active subscription.

Recurring subscriptions, cancellation and refunds

Individual and Family plans are recurring subscriptions. When you complete checkout, you authorize Care Analytics LLC to charge the selected price and applicable taxes at the billing interval shown at checkout—monthly or annually—until the subscription is canceled. Monthly plans renew each month and annual plans renew each year unless canceled before the next renewal date.

You may cancel an Individual or Family subscription from the authenticated Care Messaging app. Cancellation stops future renewal charges and ordinarily takes effect at the end of the current paid billing period, so access continues through that period unless law or the checkout terms require otherwise.

Refund policy: Except where required by law or expressly stated at checkout, fees already paid are non-refundable and we do not provide prorated refunds or credits for a partially used billing period. Nothing in this policy limits rights that cannot legally be waived.

SMS Terms & Conditions

Program name and operator: Care Messaging is an SMS reminder and caregiver-coordination program operated by the registered brand Care Analytics LLC.

Program description: With the recipient’s consent, Care Messaging sends automated, recurring, non-emergency medication, appointment, routine, wellness and daily check-in reminders, related follow-ups and caregiver-coordination messages. Recipients may reply to confirm, snooze, skip or request help. Care Messaging does not send marketing messages through this program.

Consent and enrollment: A recipient opts in by expressly agreeing during a verbal, written or other documented consent process. An authorized caregiver or care-team member records the recipient’s mobile number, consent date and consent source in Care Messaging. No reminder may be sent until consent is recorded. Consent to receive Care Messaging texts is not a condition of purchasing unrelated goods or services, but the SMS reminder service cannot be provided to a recipient who has not consented.

Message frequency: Message frequency varies according to the reminders, replies, follow-ups and caregiver alerts configured for the recipient.

Messaging charges: Message and data rates may apply. Your wireless carrier’s rates and terms govern charges to your mobile account.

Opt-out: Reply STOP to opt out at any time. After a STOP request, no additional Care Messaging texts will be sent unless the recipient later provides consent and opts in again. Reply START to resubscribe where supported.

Help: Reply HELP for help. Care Messaging is not an emergency service. Call 911 or the appropriate local emergency service for urgent or emergency assistance.

Carrier and delivery disclaimer: Wireless carriers are not liable for delayed or undelivered messages. Text messages can be delayed, filtered, blocked or unavailable and should not be used as the sole method of safety monitoring.

Mobile-number responsibility: Account holders and recipients must provide an accurate mobile number and promptly deactivate or update a number that has been changed, reassigned or is no longer authorized.

No medical advice

Care Messaging and this website do not provide medical advice, diagnosis or treatment. Medication schedules and care instructions should come from qualified healthcare professionals.

Not an emergency service

Do not use Care Messaging, this website or its inquiry form for emergencies. Call 911 or the appropriate local emergency service when urgent help is needed.

No guarantee of message delivery

Text messages and electronic communications can be delayed, filtered, blocked or unavailable. Care Messaging should not be used as the sole method of safety monitoring or emergency communication.

Intellectual property

The Care Messaging and Care Analytics names, logos, website design, text and product concepts are owned by Care Analytics LLC or used with permission, except where otherwise indicated.

Acceptable use

You may not misuse the website or application, attempt unauthorized access, interfere with its operation, submit malicious content, enroll a mobile number without the recipient’s consent or use Care Messaging for unlawful, abusive, deceptive or unsolicited communications.

Third-party services

The website and application may link to or use third-party services, including payment, hosting, analytics and messaging providers. Care Analytics is not responsible for third-party content, security or privacy practices beyond its applicable obligations.

Disclaimer

The website and service are provided on an “as is” and “as available” basis to the extent permitted by law. Product descriptions may be updated as the service evolves.

Questions, privacy requests and legal notices

Business and organization questions can be submitted through the Care Messaging Pro inquiry page. Privacy, data-access, correction, deletion, consent-withdrawal and consumer-health-data requests can be submitted through the Care Messaging privacy request form. Do not include medication names, diagnoses or other sensitive health details in a public request form.
